This information is provided pursuant to article 13 "Information" of Legislative Decree 196/03 and pursuant to the European General Regulations no. 2016/679 on the protection of individuals with regard to the processing of personal data, as well as on the free movement of such data (GDPR)

1. Introduction

With the present Amadego S.R.L. (hereinafter the "Company") informs you that personal data (hereinafter the "Personal Data") of the Supplier (in the event that it is a natural person), of the Customer, of the employees or of the officers notified for carrying out the Contract and in the course of the execution of the same and of the activities connected to it and the individuals to whom the data refer (hereinafter the "Interested parties"), will be treated in accordance with this information on the processing of Personal Data.

2. Who is the data controller?

The Company with registered office in Bresso, Via Guglielmo Marconi 28 is the data controller in relation to the processing of Personal Data and can be contacted by phone or by sending a request through this page. A complete list of data processors appointed by the Company may be requested to the same with a communication to the address indicated in this Notice.

In case of necessity the Data Protection Officer can be contacted by sending a request through this page.

3. What types of Personal Data are processed by the Company?

The Company collects and processes Personal Data such as: name, surname, email address and telephone number as well as the name, registered office and tax code or VAT number.

4. For what purposes are Personal Data processed?

The Company processes the Personal Data of the interested parties for:

  • billing to the Customer linked to the services purchased by the Suppliers,
  • production of documents, shipping and/or updating document, concerning the services related to the Contract in place with the Customer or the Supplier;
  • the negotiation and execution of the Contract between the Company and the Supplier and between the same and the Customer;
  • to assert and defend its rights, also in the context of debt recovery procedures;
  • for the fulfillment of the obligations deriving from the applicable legislation, including the execution of communications to the competent and the supervisory authorities and to comply with requests coming from the same.

5. What is the legal basis of the treatment?

Processing of Personal Data is mandatory:

  • for the execution of the Contract in relation to the purposes referred to in the previous paragraph
  • to comply with legal obligations in relation to the purposes referred to in the previous paragraph
  • for the legitimate interest of the Company and its counterparts at the conclusion of the agreements envisaged in the previous paragraph; in relation to these purposes, adequately balanced with the interests of the interested parties as the processing takes place within the limits strictly necessary for the execution of these operations.

The refusal to provide Personal Data for the purposes indicated above would have the result of preventing the Company from concluding the Contract, and if already concluded, to continue its execution.

6. Who has access to Personal Data?

The Company could communicate the Personal Data of the Interested parties to the following categories of subjects located within the European Union: third-party service providers responsible for the processing of Personal Data, insurance companies, third-party companies that carry out commercial activities and / or payments on behalf of the Company, debt collection, service providers instrumental to the Company's activities as cloud or hosting service providers, consultants or lawyers.

7. Are Personal Data transferred abroad?

Personal Data of Interested Persons may be transferred to countries outside the European Economic Area, particularly in Australia. The Company will ensure that in this case appropriate technical and organizational measures are taken that comply with the applicable law for the purposes of transferring Personal Data.

The interested party has the right to obtain a copy of his Personal Data transferred abroad by contacting the Company at the address indicated in paragraph 9 of this Information Notice.

8. What rights does the person have with regard to his Personal Data?

With regard to his Personal Data, the interested party may, by sending a communication to the address referred to in paragraph 9, exercise his rights at any time:

  • obtain confirmation of the existence or not of personal data concerning him and have communication,
  • know the origin of the Personal Data, the purposes of the processing and its methods, as well as the logic applied to the processing carried out through electronic tools;
  • request the updating, correction or integration of Personal Data,
  • obtain cancellation, transformation into anonymous form or blocking of data that may be processed in violation of the law, as well as to object, for legitimate reasons, to the processing,
  • revoke, at any time, the consent to the processing of Personal Data, without prejudice in any way to the lawfulness of the treatment based on consent given before the revocation;

In addition to the provisions referred to in this paragraph, starting from 25 May 2018, the interested party may avail himself of the additional rights envisaged in the following paragraph 10.

9. How to contact the data controller?

If the interested party or the Supplier have any doubts concerning this privacy policy or wish to exercise the rights set forth in this statement, they can contact the owner of the personal data processing by clicking here.

10. What will change from 25 May 2018?

The following forecasts will become effective as from 25 May 2018, as a consequence of the beginning of the effectiveness of the EU General Regulation on the processing of personal data 679/2016 (hereinafter the "Privacy Regulation").

Retention of Personal Data: Personal Data collected for the purposes referred to in paragraph 4 will be kept for a period equal to the duration of the Contract and for the 10 years following the termination of the same, without prejudice to cases where conservation is required for a subsequent period for any disputes, requests by the competent authorities or pursuant to the applicable legislation.

Further rights of the interested party: the interested party may, at any time in the circumstances envisaged by the Privacy Regulations:

  • ask the Company to limit the processing of data;
  • oppose at any time the processing of your data;
  • request cancellation of data concerning him without unjustified delay
  • obtain the portability of data concerning him.

Right of complaint: the interested party will have the right to lodge a complaint with the Guarantor for the Protection of Personal Data where the conditions exist.

11. Changes and Updates

This information is valid from 25/05/2018.

The Company could also make changes and/or additions to said disclosure, also following the beginning of the effectiveness of the Privacy Regulations and any subsequent amendments and/or regulatory amendments.
